By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

They will also be notified of possible message and data rates, variable message frequency, and instructions to text HELP for support or STOP to unsubscribe. 6) Privacy & Cookies

You represent that you own or have the necessary rights to your User Content and that it does not infringe or violate any rights or laws. We may remove User Content at our discretion.
9) Third-Party Services & Links
The Site may link to or embed third-party websites, tools, or content (e.g., maps, analytics, scheduling widgets, customer portals). Those third parties’ terms and privacy policies govern their services. ELITE Home Trade Pros is not responsible for third-party sites or services.
10) Availability & Disclaimer
We aim to keep the Site available and accurate but do not guarantee that the Site or its content will be error-free, uninterrupted, or secure. The Site is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, or non-infringement.

TO THE FULLEST EXTENT PERMITTED BY LAW, ELITE HOME TRADE PROS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE.
12) Indemnification
You agree to indemnify, defend, and hold harmless ELITE Home Trade Pros from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) use of the Site; (b) violation of these Terms; or (c) infringement of any third-party rights.
13) DMCA Notice
If you believe that user-uploaded content on the Site infringes your copyright, please fill out our Service Provider's automated DMCA Copyright Complaint Form. We may remove content and, when appropriate, terminate repeat infringers.
14) Governing Law & Venue
These Terms are governed by the laws of South Dakota, without regard to its conflicts-of-law principles. You agree to exclusive jurisdiction and venue in the state or federal courts located in Minnehaha County, South Dakota, unless otherwise required by law.
15) Termination
We may suspend or terminate your access to the Site at any time and for any reason, including if we reasonably believe you have violated these Terms. You may stop using the Site at any time. Sections that by nature should survive (e.g., IP, disclaimers, liability limits, indemnity, governing law) will survive termination.
16) Entire Agreement; Severability; Waiver
These Terms and the Privacy Policy constitute the entire agreement between you and ELITE Home Trade Pros regarding the Site. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our rights.
